Terms of Service
Effective July 27, 2026
1. The deal
SwingOps is a software platform, operated by Swing Science Hitting Lab Inc., doing business as Swing Science Technologies (an Illinois corporation at 2425 W Lawrence Ave, Chicago, IL 60625), that helps baseball and softball training facilities operate their businesses. These Terms cover both facility operators who run their facility on our platform and families and athletes who interact with a facility through SwingOps-powered surfaces (the booking widget, customer portal, SMS messages, and emails). By using the platform — or by accepting messages we send on behalf of a facility — you agree to these Terms and to our Privacy Policy.
2. SwingOps Facility Messaging — SMS program disclosures
The following terms apply to every SMS message sent through SwingOps on behalf of a facility brand. They're required by US wireless carriers and by the A2P 10DLC Campaign Registry, and they govern the messaging relationship between you and the facility you train with.
- Program name
- SwingOps Facility Messaging — a multi-tenant SMS program operated by SwingOps as the platform, with each facility registered as a distinct sub-brand sender.
- Program description
- Recurring SMS messages from a facility brand to a family that has opted in. Content includes: lesson reminders, package-low or wallet-low nudges, post-session review requests, recovery messages for abandoned bookings and unsigned waivers, welcome follow-ups, and occasional promotional updates about camps, clinics, and tryouts at the facility.
- Message and data rates
- Message and data rates may apply. The facility does not pay the carrier on your behalf; charges are between you and your wireless carrier.
- Message frequency
- Frequency varies. Active customers typically receive 1–5 messages per week. Transactional messages (reminders, recovery, receipts) fire only when a relevant event happens. Promotional messages are capped at one per family per 24-hour window.
- Support
- For help with messaging, email support@swingops.ai or contact your facility directly. For privacy requests, email privacy@swingops.ai.
- Opt-out
- Reply STOP to any message at any time to unsubscribe. We honor STOP on our inbound webhook by writing the sending number to a platform-wide suppression list that blocks all future SwingOps SMS to that number. To restart messages after a STOP, reply UNSTOP or START.
- Help
- Reply HELP to any message for a short help reply that identifies the sending facility and points to facility contact information. You can also email support@swingops.ai at any time.
- Opt-in
- Consent is captured by (a) checking the SMS-consent box on the facility booking flow, (b) checking the same SMS-consent box on the facility contact / lead-capture form, or (c) texting START, YES, or UNSTOP to the facility number. Both checkboxes are unchecked by default and require an affirmative check, and consent is never a condition of purchase. Consent is per-facility; opting out of one facility does not affect any other facility you may train with.
- Carriers
- Wireless carriers are not liable for delayed or undelivered messages. We use industry-standard 10DLC long codes registered through The Campaign Registry; deliverability follows carrier rules outside our direct control.
3. Your SwingOps account
If you create an account (either as a facility operator or as a family member using the customer portal), you are responsible for keeping your credentials safe, for activity that happens under your account, and for the accuracy of the information you enter. We may suspend or terminate accounts that violate these Terms, that abuse the platform, or that we are legally required to suspend.
4. Acceptable use
You agree not to use SwingOps to:
- Send messages to recipients who have not opted in or who have opted out.
- Send content prohibited by US wireless carriers (gambling, controlled substances, hate speech, S.H.A.F.T. categories, sexual or pornographic content).
- Send false, misleading, or impersonating messages.
- Attempt to circumvent rate limits, suppression lists, or carrier filtering.
- Reverse-engineer the platform, probe for vulnerabilities (outside a coordinated security disclosure), or use SwingOps to harm third parties.
- Use the platform in violation of US, state, or local law (including TCPA, CAN-SPAM, GDPR, CCPA where applicable).
Facility operators are independently responsible for compliance with consumer protection, payments, and child-protection law in the jurisdictions where they operate.
5. Payments
Facility subscription billing is handled by our third-party payment processor on the SwingOps platform account; charges to customers (lessons, packages, memberships) are processed through that processor's connected-account system on the facility's account. We never store full card numbers; payment data lives with the processor. Refund and cancellation rules are set by the facility through their booking rules; SwingOps facilitates the transaction but is not the merchant of record for facility charges.
6. Intellectual property
SwingOps owns the software, designs, and content of the platform. You retain ownership of the data you enter — your facility's catalog, your family's profile, your athlete's information, your messages. We use that data only to operate the service, per the Privacy Policy.
7. Disclaimers and limitation of liability
The platform is provided “as is.” To the maximum extent allowed by law, SwingOps disclaims all warranties (express, implied, statutory) including merchantability, fitness for a particular purpose, and non-infringement. Our aggregate liability for any claim related to SwingOps is limited to the amounts you paid SwingOps in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages. Nothing in these Terms limits liability that cannot be limited under applicable law.
8. Indemnity
You agree to defend, indemnify, and hold harmless SwingOps from claims arising out of your violation of these Terms, your unlawful or unauthorized use of the platform, or your operation of a facility on the platform — including consumer-protection or messaging-consent claims arising from a facility's use of SwingOps. This section does not apply to a family or athlete acting solely as an end user of a facility on the platform.
9. Termination
You may stop using SwingOps at any time. Facility operators may cancel their subscription from /settings/subscription in the dashboard; cancellation takes effect at the end of the current billing cycle. We may suspend or terminate accounts that violate these Terms, with notice where reasonable. After termination we will retain operational records per the retention rules in the Privacy Policy and respond to data-export and deletion requests as required by law.
10. Governing law and disputes
These Terms are governed by the laws of the State of California, USA, without regard to conflicts-of-law principles. Disputes will be resolved in the state or federal courts located in Orange County, California, and you consent to personal jurisdiction in those courts. Nothing here prevents you from filing complaints with regulators or industry self-regulatory bodies.
11. Changes
We may revise these Terms from time to time. Material changes will be posted at the top of this page with a new effective date and, where required, communicated by email or in-app notice. Continued use after the effective date constitutes acceptance.
